Montgomery County Arrest History

If written proof is needed, ask the Montgomery County Sheriff's Office for the releasable adult booking or intake record. Include the arrest date, approximate time, agency, place, incident number if known, and the fields sought. Virginia law treats adult arrestee identity, charge status, and an initial booking photograph differently from a full investigative file. Redactions and temporary withholding may still apply, especially during an active felony investigation.

- For a consent-based statewide name check, submit SP-167 to the Virginia State Police CCRE through CARE. The subject's sworn, notarized consent is required, and mailed processing is not same-day.
- When no portal supplies the record, make a specific Virginia FOIA request by email, mail, phone, or in person. Ask for an existing record rather than an explanation or new report.

A police narrative may include facts that are exempt as investigative material. Requesters can ask the office to cite the legal basis for each withheld portion rather than assuming the whole file must be open.
Montgomery Booking Records by FOIA
The Montgomery County FOIA channel for sheriff records goes to Capt. Mark Hollandsworth at mcso-info@vamcso.org. A request may also be mailed, phoned, or made in person. It need not use the word FOIA, but it must describe existing records with reasonable detail. Virginia FOIA access applies to Virginia citizens and qualifying Virginia media, and the office may ask for a legal address.
The standard response period is five working days, beginning the day after receipt. The Montgomery County office may produce the records, redact or withhold with a precise citation, say no record exists, refer the requester to another holder, or invoke seven more working days in writing. Actual search, access, duplication, and supply costs may be charged. An estimate above $200 can require a deposit, while an unpaid bill older than 30 days can delay a new request.

Booking Logs and Recent Arrests
Because Montgomery County publishes no official daily booking list, a recent-arrest check begins by identifying the likely agency and calling the jail. Then request the agency report and check OCIS after the charge is docketed. Booking can occur before a court file appears, so a same-day no-result message is not proof that the event did not happen. The General District clerk or Circuit criminal division can help when OCIS reports that records are unavailable.

Montgomery Arrest Fingerprints Reach CCRE
Virginia law requires reportable arrest data and fingerprints to flow from the arresting agency to the Central Criminal Records Exchange. The jail may also capture fingerprints and a booking photograph during intake. A later court disposition and correctional status should be reported back to CCRE, normally within 30 days. That record flow connects the arrest cycle to its outcome, but the systems remain separate.
Late or unmatched reports can leave a gap. CCRE tracks information that cannot yet be applied to the right cycle. The SP-167 form also warns that a name-only result stating no Virginia conviction data does not rule out an arrest record. For that reason, self-review should compare the state response with the arresting agency and the court. If the state entry is wrong, VSP directs disputes about source information back to the submitting arresting agency.
Montgomery Arrest Charges Move to Court
An intake charge is an allegation at one point in time. Montgomery General District Court handles adult misdemeanors and the preliminary stage of a felony. A certified felony moves to Circuit Court, where an indictment, plea, amended charge, trial, dismissal, sentence, or appeal may change the legal picture. The arrest record does not rewrite itself into the full case outcome.
OCIS can show the original and amended charge, court status, hearings, plea, disposition, and sentence when available. It may not contain every underlying document. Arrests Are Not Convictions
Montgomery County arrest records and conviction records answer different questions. Police and the Sheriff document an arrest and jail intake. General District or Circuit Court records the prosecution and disposition. CCRE may later connect reported arrest fingerprints to the court result, but a repository gap does not erase the source records.
